1. Agreement to Terms

By accessing and using DDMARC ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Use License

Permission is granted to temporarily access and use DDMARC for personal or commercial purposes, subject to the restrictions in these Terms of Service.

This license shall automatically terminate if you violate any of these restrictions.

3. Account Terms

• You must be 18 years or older to use this Service.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all activity under your account.
• You may not use the Service for any illegal or unauthorized purpose.

4. Subscriptions and Billing

Free Plan: Includes up to 3 domains with basic features. No credit card required.

Paid Plans: Billed annually or monthly as selected. All fees are in USD and non-refundable except as required by law or as explicitly stated in our refund policy.

MSP/White-Label Plans: Minimum 100 domains required. Billed monthly at $1 per domain. Custom arrangements may be made for large deployments.

We reserve the right to change our subscription plans and pricing with 30 days notice to existing customers.

5. Refund Policy

We offer a 30-day money-back guarantee on all paid plans. If you're not satisfied with the Service, contact us within 30 days of your initial purchase for a full refund. Refunds after 30 days are at our discretion.

6. White-Label Services

White-label customers may rebrand and resell the Service under their own brand name. However:

• You may not misrepresent the Service as your own proprietary technology.
• You remain responsible for your customers' compliance with these Terms.
• You must maintain the minimum domain requirements for the MSP plan.
• Custom branding must not infringe on third-party trademarks or intellectual property.

7. Acceptable Use

You agree not to:

• Use the Service to send spam or unsolicited commercial email.
• Attempt to gain unauthorized access to any portion of the Service.
• Interfere with or disrupt the Service or servers.
• Use the Service for any illegal activities.
• Impersonate any person or entity.
• Violate any applicable laws or regulations.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process DMARC reports and DNS data to provide the Service. We do not sell your data to third parties.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by DDMARC and are protected by international copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

DDMARC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold DDMARC harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
